Wrongful Death

A wrongful death lawsuit claims that the victim was killed as a result of negligence (or other type of unjust action) on the part of the person or entity being sued, and that the victim’s survivors are entitled to monetary damages as a result of the improper conduct.

There are many types of wrongful death cases. Below is a list list of the most common civil lawsuits involving wrongful death:

  •  Medical Malpractice
  •  Medication or pharmacy error
  •  Nursing home liability
  •  Auto accidents
  •  Plane and aviation accidents
  •  Train and other mass transportation accidents
  •  Premises liability accidents
  •  Product liability
  •  Other personal injury

Who is eligible to file a wrongful death lawsuit?

In most states, dependents and immediate family members (including parents, spouses, and children) of a deceased person are eligible to file a wrongful death lawsuit. Children may also recover damages for the loss of parental companionship and guidance, as well as for mental pain and suffering resulting from the death. Under some circumstances, other family members may be permitted to file a wrongful death lawsuit.
